Advice on the geographical area to be protected

Trademark registrations are geographically restricted. Protection extends only over the area in which the registration is valid. Although protection is often sought in the largest possible geographical area, the extent of this area is restricted by the investments associated with the trademark registration and the applicable usage obligation for trademarks. The usage obligation means that you must use the trademark at a given moment in the area in which it has been registered. If this legal obligation is not met, you can then no longer avail yourself of the protection of your trademark.

Arnold + Siedsma provides its clients with expert advice on these considerations, so that you obtain the best possible protection for your trademarks according to your own specific circumstances. This obviously takes into account the nature of your products or services, your future expectations, the characteristics of your market and your international ambitions.

This strategic advice is also intended to guide you through the existing maze of international treaties and national legislations along a path that takes account of your interests with the aim of obtaining trademark protection.
